Thank you for your letter of December 18, 2002. I appreciate your acknowledgement of some of the problems, although I don’t believe we are talking the same language.

I find your paragraph 2 somewhat confusing as to past pipeline reclamation and future lease site reclamation. Your expectations and requirements of how your personnel conduct their work have not been fulfilled, as the pictures I sent you would verify. You also say that you expect your personnel to be receptive to constructive suggestions during the process. I was expressing my concerns of the poor workmanship at the time the pipeline reclamation was being done but all I got was a contractor who said he had done all he was going to do and a Murphy personnel ***** who was satisfied with the very poor job. With my experience on a very simple reclamation I have serious reservations on what you may do to a more major reclamation such as the lease site. I had a lot of assurances on the pipeline on how it was going to be looked after, but these assurances were worth nothing in reality, not even written requests.

Your reference to conflict between landowners and oil and gas operations stemming from misunderstandings is not applicable in this case. When issues are written into the contract and posted at the entrance to the site and still ignored this is not misunderstanding. When you add the phone calls and letters and problems still continue this becomes a “ just don’t give a damn attitude”. In reference to your “ third party to prevent further misunderstandings”, I don’t believe the problems have been misunderstandings.

I had a talk with ****** and ****** prior to the pipeline construction. At the time I don’t believe ****** was very knowledgeable on leases as he had ****** explain my concerns to him. My requests had every “i dotted and t crossed” and they could find no error in it, but ****** still would not go for it. When I presented a billing for my time ****** became very upset. ****** did not know that you have to pay the landowners for their time. ****** explained to him that you have to pay us. He then would not pay the full amount because he said some of it related to Beau. I phoned ****** when I had trouble with gates and he was “going to get on it right away”, nothing got done as the gates were still left open. I believe ****** was also instrumental in changing part of a contract and I was asked by ****** to sign the paper and no mention was made of the change.

You may have enormous confidence in this man, but my experience does not allow me to share this confidence.

In conclusion I am re requesting a meeting with you at my place.

Note: Received a letter from Murphy president in Janurary 2003. Mr.****** again refused my request for a meeting. No mention of my concerns were addressed except for clarification that when he referred to pipeline reclamation he was also refering to well site reclamation.
