I received a registered mail [posted without the decency of a return address on the envelope] from Berkana on September 6, 2007 giving notice of a proposed gas well on 7 20 42 3W5 (surface location) Please consider this letter as a letter of objection to Berkana’s proposed well on 7 20 42 3W5.

 

I have many serious outstanding issues with Berkana Energy Corp.

 

I am requesting at this time Berkana address and resolve all my concerns on 6 21 42 3W5 before proceeding with a well on 7 20 42 3W5 (surface location).

 

Being that Berkana has acquired from Murphy Oil, a well site on my property being 6 21 42 3W5, and being that Murphy Oil suggested all further correspondence be directed to Berkana Energy, I shall direct my objections and concerns related to (Murphy Oil/Berkana Energy) as Berkana.

 

As there are numerous concerns between Berkana and myself, I shall attempt to list only a few and shall keep detail short. It is very important that the EUB is aware and understands how I have been

mistreated, exploited and extorted by Berkana.

 

This letter is intended as a letter of objection and as a request to the EUB to refuse the issuance of a license to Berkana to develop a well on 7 20 42 3W5 (surface location) as per WILSONCK 8-20-42-3. Berkana must not be allowed to carry on with new wells in light of the exploitation of the landowners and the mess Berkana is leaving behind. I am asking that the EUB take steps to fully understand my position before considering an application from Berkana re: WILSONCK 8-20-42-3W5.

(1)  My 5 year lease rental review was due March of 2005. The last year of the 5 year lease was March 2006. I asked for a review and it never did happen.                                                                                                                                                                                                       

(2)  Berkana’s lease rental for 2007 is only a few days away from being 6 months overdue.

(3)  Berkana has failed to attempt to come to a mutually agreed to plan for reclamation.

(4)  The weeds on the lease site including Canada Thistle have been allowed to grow rampant and spread for years.

(5)  Berkana owes for trees on my private property that were burned because of careless flaring on their well site.

(6)  Berkana was to have reworked and reseeded a pipeline right of way years ago. This work has never been done.

(7)  Annual crop loss payment on pipeline right-of-way is due in October of 2007. If Berkana follows suit with their past performance, I doubt that I shall be paid for this crop loss without having to pursue Berkana.

(8)  Berkana owes on past lease rental amounts because of the unscrupulous actions of a landman.

(9)  Berkana owes for personal property damage in my yard.

 

These are only a few of the many outstanding issues that I have with Berkana.

 

On a slightly different issue: I received a copy of the survey plan for the proposed Berkana well site on 7 20 42 3W5. The survey is saturated with errors and for Berkana to provide this survey plan to the EUB as part of Berkana’s application would be providing the EUB with erroneous information.

 

I find it very disturbing that **************** (Alberta Land Surveyor) would certify that the plan was true and correct to the best of his knowledge. Note the following as relates to the aforementioned survey plan.

 

(a)The survey shows 2 residences on the north part of SE 20 42                                                                  3W5. This is erroneous.

(b) The survey shows the closest residence to the well site to be .52 kilometers to the SW. This is erroneous.

(c) One part of the survey and accompanying letter shows Rimbey to be 8.84 km from the well, another part says Rimbey is 5 kilometers from the well site. At least one if not both those figures are erroneous.

(d) The survey does not show a residence on the south part of SE 20 42 3W5. This is erroneous.

(e) Your survey development plan shows 1 residence on SE 21 42 3W5. This is erroneous.

(f) Your survey states the survey was performed between the 16th and 17th of August 2007. This is erroneous.

 

These are just the glaring errors. How many more are there?

 

 For the record, your surveyors left the gate open at the NW corner of my property at SW 21 42 3W5.
